What Do We Need to Know About the Import Inspection of Mobile Machines Used Outside Roadways in Industrial Machine Noise Measurement (Product Safety and Inspection: 2024/2) Regulation?

Construction Equipment Noise Measurement The notification published in the Official Gazette dated December 31, 2023, and numbered 32416 entered into force on June 30, 2024. The purpose of this notification is to Machinery Safety Regulation (2006/42/EC) and the Regulation on Requirements for Gas and Particulate Pollutant Emission Limits and Type Approval for Internal Combustion Engines Installed on Mobile Machinery Used Outside the Road (2016/1628/EU), and the Regulation on Environmental Noise Emission from Equipment Used in Open Areas(2000/14/EC) for the following machinery:

* 8429.20.00.00.11 Graders with GTP code

8429.40.10.00.11 Road rollers with vibrators and rubber wheels for compacting work by means of a hammering action

8429.51.99.10.11 Machines with rubber wheels capable of digging soil, classified under Gtip

8429.52.10.00.00 Gtip-listed palletized excavators

8429.52.90.00.11 Machines with a 360-degree rotating tower and rubber wheels, classified under Gtip code

8429.59.00.10.11 Beko Loader with Gtip

8413.40.00.00.00 Concrete Pumps with Gtip

8430.41.00.00.00 Self-propelled drilling and boring machines

1- Import Inspection Pre-Approval Application: Importers apply for import inspection pre-approval through the TAREKS system available on the Ministry’s website under the “E-Services” section.

2-Document Certification: The first and last pages of the EU Conformity Declaration and Type Approval Certificate for the product to be imported must be certified by the Turkish mission in the product’s country of origin.

3-Upload via TAREKS: The certified documents are uploaded to the TAREKS system.

4- Document Check: The documents uploaded to TAREKS are checked, and if any missing or incorrect documents are detected, the preliminary approval is rejected.

5- Physical Inspection and Laboratory Testing: After the preliminary approval is granted, the imported batches are subject to physical inspection and necessary laboratory tests. If suitable environmental conditions are met (sufficient measurement area, suitable weather conditions, etc.), a noise emission conformity assessment in accordance with 2000/14/EC may be conducted by a local authorized body, subject to obtaining permission from the ministry.

6- Inspection Applications: Import inspection applications for approved products are submitted by the authorized user via TAREKS.

7-Referral for Actual Inspection: If the applications are deemed appropriate, the products are referred for actual inspection, and the process begins.

8- Inspection Process: The inspection verifies the conformity of the products, the validity of the standards specified in the documents, and their compliance.

9-Conclusion and Sanctions: If non-compliance is detected in the Industrial Machine Noise Measurement, the company’s inspection authority may be suspended, and its applications may be referred to physical inspection for a certain period.
